Here is some advice our panel of experts gave about INCIDENTS to our subscribers:
Question:
Help! An injury’s occurred. Am I as the contractor responsible, or the client who hired my company?
A worker fell off scaffolding on site. As the contractor, am I responsible, or the client who hired my company?
Answer:
The company who employed you is responsible for preventing employees from being injured. You’re responsible for seeing that this is complied with. You’re also responsible for the costs of the treatment of injury through the COID Commissioner. If you’re not registered with the COID Commissioner, the company will have to foot the bill through the COID Commissioner. The company should thus ensure the contractor’s good standing with the COID Commissioner and effective management of safety risks on the construction site.
